Terms of Service

1. Acceptance of Terms

By accessing or using the Dewie application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you should not use the App.

The App is intended for use by law enforcement professionals in the course of their official duties. By using the App, you represent that you are a qualified law enforcement professional authorized to conduct field sobriety tests.

2. Description of Service

Dewie is an application designed to assist law enforcement officers in conducting and documenting standardized field sobriety tests (SFSTs) during DUI investigations. The App provides guidance, documentation tools, and report generation for these tests.

While the App is designed to follow standardized protocols, it is a supplement to, not a replacement for, proper training and professional judgment. Users are expected to have received appropriate training in conducting field sobriety tests and to exercise their professional judgment when using the App.

3. User Accounts

To use the App, you must create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to:

• Provide accurate and complete information when creating your account
• Update your information to keep it current
• Protect your account credentials and not share them with others
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, are being used inappropriately.

4. Acceptable Use

You agree to use the App only for its intended purpose of assisting in legitimate law enforcement activities. You will not:

• Use the App for any illegal purpose or in violation of any laws or regulations
• Use the App to harass, abuse, or harm another person
• Interfere with or disrupt the App or servers or networks connected to the App
• Attempt to access parts of the App that you are not authorized to access
• Use the App in any way that could damage, disable, overburden, or impair it
• Attempt to reverse engineer, decompile, or disassemble the App
• Create false reports or enter false information

5. Intellectual Property

All content included in the App, such as text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of Big Sky Digital Foundry, LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

The App and all its content are provided for your use in accordance with these Terms. You may not copy, reproduce, distribute, transmit, display, sell, license, or otherwise exploit any content from the App for any other purposes without the prior written consent of Big Sky Digital Foundry, LLC.

The Dewie name, logo, and related marks are trademarks of Big Sky Digital Foundry, LLC and may not be used without permission.

6. User Data and Reports

You retain all rights to the data you enter into the App. However, by using the App, you grant us a non-exclusive license to use, store, and process that data solely for the purpose of providing and improving the App's services to you.

Reports generated by the App are intended to assist in documenting field sobriety tests. You are responsible for reviewing all reports for accuracy before using them for official purposes.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL FUNCTION UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

THE APP IS DESIGNED TO ASSIST IN FIELD SOBRIETY TESTING, BUT THE ACCURACY AND RELIABILITY OF THE TESTS DEPEND ON PROPER ADMINISTRATION BY TRAINED PERSONNEL. WE MAKE NO GUARANTEES REGARDING THE RESULTS OF TESTS CONDUCTED USING THE APP.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIG SKY DIGITAL FOUNDRY, LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP
• ANY CONTENT OBTAINED FROM THE APP
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
• RELIANCE ON THE RESULTS OF TESTS CONDUCTED USING THE APP

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE APP.

9. Indemnification

You agree to indemnify, defend, and hold harmless Big Sky Digital Foundry, LLC and its affiliates, officers, employees, agents, partners, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to your use of the App or violation of these Terms.

10. Modifications to the App and Terms

We reserve the right to modify, suspend, or discontinue the App or any part of it at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

We may revise these Terms from time to time. The most current version will always be posted on our website. By continuing to use the App after revisions become effective, you agree to be bound by the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Montana, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within Montana for the resolution of any disputes.
