Terms of Service

These Terms of Service (“Terms”) govern your use of the Dewie iOS application and the dewie.app website (together, the “Service”), operated by Big Sky Digital Foundry, LLC (“Dewie,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who may use Dewie
Dewie is intended for law enforcement personnel and authorized department administrators. You must be at least 18 years old and authorized by your agency (where applicable) to create an account and document impaired driving evaluations.
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us promptly at support@dewie.app if you believe your account has been compromised.
2. The Service
Dewie provides guided workflows for documenting Standardized Field Sobriety Tests (SFST), ARIDE assessments, and Drug Recognition Expert (DRE) evaluations, and generates PDF reports from the information you enter. Dewie does not contain generative artificial intelligence and does not draft narrative content on your behalf.
Dewie is a documentation tool. It does not provide legal advice, medical advice, or training certification. You remain solely responsible for conducting evaluations in accordance with your training, department policy, and applicable law.
3. Accounts and departments
Individual officers may create an account and, where offered, use a limited trial. Departments may purchase seat-based licenses. When you join a department with an invite code, your account becomes associated with that department, and department administrators may manage seats, certifications, and account status within their department as described in the Service.
We may suspend or terminate access if an account is disabled by a department administrator, if a department license expires or is deactivated, or if we reasonably believe these Terms have been violated.
4. Subscriptions and fees
Department pricing and any individual App Store subscriptions are described in the Service or in a separate agreement with your agency. App Store purchases are billed by Apple and are subject to Apple's payment terms. Canceling or deleting your Dewie account does not automatically cancel an App Store subscription; you must manage App Store subscriptions through your Apple ID settings.
Fees are non-refundable except where required by law or by Apple's refund policies for App Store purchases.
5. Your content and reports
You retain responsibility for the accuracy and completeness of information you enter. By submitting a report, you represent that you are authorized to create that record in the course of your duties.
Submitted reports are immutable through the Service: they cannot be edited or deleted by officers, department administrators, or Dewie staff through the application. Report retention is governed by your department's records policies and applicable law. When you delete your account, we remove or anonymize your account credentials and personal profile information. Submitted reports may be retained in anonymized form so that case documentation remains available for lawful purposes.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, or to falsify or fabricate evaluation records.
- Attempt to access another person's account, reports, or department data without authorization.
- Interfere with or disrupt the Service, including by probing, scraping, or reverse engineering except where permitted by law.
- Share invite codes or credentials outside your authorized agency use.
- Misrepresent your identity, certifications, or affiliation.
7. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Service, you consent to that policy.
8. Account deletion
You may delete your account from within the Dewie iOS app (Profile) or the officer portal on dewie.app. Deletion removes your ability to sign in and deletes or anonymizes personal account information. Submitted reports may remain for records retention as described above. If you have an active App Store subscription, cancel it separately through Apple.
9. Intellectual property
The Service, including its software, design, branding, and documentation, is owned by Big Sky Digital Foundry, LLC or its licensors. These Terms do not grant you any ownership interest in the Service. You may not copy, modify, or redistribute the Service except as expressly permitted by us in writing.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or available in every location or network condition.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIG SKY DIGITAL FOUNDRY, LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU (OR YOUR DEPARTMENT) PAID TO US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM.
Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Indemnification
You agree to indemnify and hold harmless Big Sky Digital Foundry, LLC from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right in connection with your use of the Service.
13. Changes to the Service or Terms
We may update the Service and these Terms from time to time. When we make material changes to these Terms, we will update the date at the top of this page. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Governing law
Dewie is offered for use by authorized law enforcement personnel wherever the Service is available. These Terms are governed by the applicable laws of the United States and the state in which Big Sky Digital Foundry, LLC is organized, without regard to conflict-of-law rules that would require another jurisdiction's law. If a court of competent jurisdiction finds any provision of these Terms unenforceable, the remaining provisions will continue in effect.
